1. Agreement to Terms
By accessing and using NOVAQY's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
NOVAQY Cloud LLP ("NOVAQY," "we," "us," or "our") is an India-based company providing remote technical support services to customers in the United States and Canada.
2. Services
NOVAQY provides remote technical support services including but not limited to:
- MSP B2C Support Services
- Managed Hosting
- Managed IT (B2B)
- MSSP services
We operate remotely and do not offer onsite visits. We do not perform data recovery services.
3. Account and Access
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Subscriptions and Renewals
Subscriptions are billed annually. We provide transparent pricing with renewal notices and "click-to-cancel" support. You may cancel your subscription at any time, but refunds are governed by our Resolution-Based Refund Policy.
5. Billing
Charges are in USD or CAD as quoted. Late fees may apply after notice. All payments are processed securely through compliant payment providers.
6. Warranties
Services are delivered with reasonable care and skill. We promise 100% satisfaction with every support session. If we cannot resolve your issue, you receive a full refund per our Resolution-Based Refund Policy.
7. Limitation of Liability
NOVAQY shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services. Total liability is capped to 12 months of payments.
We are not responsible for data loss. You are responsible for maintaining backups of your important files.
8. Compliance
You must comply with export controls, privacy, and security laws. You indemnify NOVAQY for claims arising from unlawful use of our services.
9. Governing Law
These terms are governed by the laws of India, with jurisdiction in New Delhi courts. For consumers, mandatory rights under local laws may apply and cannot be limited.
10. Dispute Resolution
In case of disputes, contact our support team first. We will attempt to resolve issues within 30 days. If unresolved, disputes will be subject to binding arbitration in New Delhi, India.
